This two-day capacity development workshop on Risk Management in Construction Contracts and Disputes is designed to provide participants with practical insights into identifying, assessing, and managing risks at every stage of a construction contract — from tendering to execution and dispute resolution.

Amit Kathpalia has been in the construction industry for 40 years with 35 years in Govtn including 9 years as Chief Engineer and five years in corporate as VP. He is a Civil engineer with an M.Tech in Geotech Engineering from IIT and an LLM In International Construction Contracts from Pantheon Assas University of Law, Paris. He is a Visiting Professor at RICS School of Built Environment, NLU Delhi and National Institute of Construction Management and Research University(NICMAR), Adjunct Faculty at L&T Institute of Project Management, L&T Edutech, and a corporate trainer. He has taken training sessions of more than 125 companies in India and abroad during last four years. He is also the author of a book – “Practical Construction Contract Issues Which are not Commonly Understood”. He is currently the managing partner of Boutique Techno-legal firm “Klaims and Qwantum International” and Infrastructure Advisory Firm “AK Infrastructure Advisory”.

Course Agenda
- The two-day workshop will cover risk management across different stages of construction contracts, from tendering to dispute resolution. The program will begin with risk management at the tendering stage, focusing on how to identify and analyze risks while drafting and evaluating tender documents, frame an effective contract strategy, and apply negotiation skills during the tender stage. Participants will also explore real-life case studies highlighting the consequences of overlooked risks during tendering. The workshop will then move to risk management during the contract execution stage, where participants will learn how contractual clauses are interpreted legally and contractually when uncertainties arise, such as unforeseen site conditions. This session will also cover claim preparation and quantification, common misconceptions in claims, and the importance of proper contractual communication through interactive role-play exercises between contractors and employers. The final part of the program will focus on risk management in disputes, with particular emphasis on arbitration and alternative dispute resolution mechanisms. Participants will learn about preparing for disputes, crafting strong claims and reliefs, proving claims effectively, enforcement and legal challenges, and the use of mediation and other ADR tools. The workshop will also include engaging activities such as expert witness simulations and mock arbitration to provide practical learning and hands-on experience in dispute resolution.
