Amit Kathpalia has been in the construction industry for 40 years with 35 years in Govtn including 9 years as Chief Engineer and five years in corporate as VP. He is a Civil engineer with an M.Tech in Geotech Engineering from IIT and an LLM In International Construction Contracts from Pantheon Assas University of Law, Paris. He is a Visiting Professor at RICS School of Built Environment, NLU Delhi and National Institute of Construction Management and Research University(NICMAR), Adjunct Faculty at L&T Institute of Project Management, L&T Edutech, and a corporate trainer. He has taken training sessions of more than 125 companies in India and abroad during last four years. - This intensive two-day programme provides a comprehensive understanding of construction contracts, beginning with identifying “red flag” clauses in construction and consultancy agreements, understanding essential contract features, selecting appropriate contract structures, and effectively allocating risks to ensure project success. It further covers the legal and practical interpretation of contracts, including key provisions of the Indian Contract Act, 1872, along with insights into commonly used clauses through real-life case discussions. The programme also focuses on drafting critical contract clauses such as extension of time, delay management, liquidated damages, indemnities, termination, force majeure, assignment, novation, and time-bar provisions, along with handling variations, unforeseen site conditions, defects, and dispute resolution mechanisms including ADR. Participants will also learn to address unfair clauses like “no damages for delay,” “no interest on delayed payments,” “no claim certificates,” and liability caps, followed by practical guidance on dispute management, including drafting arbitration clauses, managing arbitration proceedings, challenging arbitral awards, and exploring mediation as an effective alternative.
